Section 12.04.130 Solicitation of contributions on highways.

    No person, (as defined in the Illinois Revised Statutes, Chapter 95 1/2, Section 1-159, to include every natural person, firm, co-partnership, association or corporation) shall stand on a highway in the city (as defined in the Illinois Revised Statutes, Chapter 95 1/2, Section 1-126, to include the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel), for the purpose of soliciting contributions from the occupants of any vehicle, except as follows:
    A.    Solicitation on highways within the city shall be allowed only at intersections where all traffic is required to come to a full stop.
    B.    The soliciting agent shall be:
    1.    Registered with the attorney general as a charitable organization as provided by "An Act to regulate solicitation and collection of funds for charitable purposes, providing for violations thereof, and making an appropriation therefor," approved July 26, 1963, as amended (Illinois Revised Statutes, Chapter 23, Section 5101, et. seq.);
    2.    Engaged in a state wide fund raising activity; and
    3.    Liable for any injuries to any person or property during the solicitation which is causally related to an act of ordinary negligence of the soliciting agent.
    C.    Any natural person engaged in the act of solicitation shall be sixteen (16) years of age or more and shall be wearing a highly visible vest. (Ord. 469 § 1, 1980: prior code § 33-1-16)
